Article 1. Section 8
"The Congress Shall Have The Power To Declare War"
This cartoon relates to the article 1 sect.8 of the constitution because the power to declare war is up to congress and not the president. It also relates to my article because on the left side we see Obama (before his presidency) saying what the rules are concerning a declaration of war . On the right side (while he's president) he decides that all of a sudden the rules no longer matters.
'The Congress Shall Have Power ... to Declare War'
CONOR FRIEDERSDORF AUG 27 2014, 8:53 AM ET
In this article, Senators Bob Corker, Rand Paul, and Tim Kaine all agree that Congress should be consulted before President Obama takes any more military action in Iraq or Syria. They believe that in such a serious matter, Congress and the administration must be united on U.S. policy. Senator Tim Kaine says that the administration should clearly define the strategy and objectives of its mission ... then bring it to Congress for a debate and authorization vote. in 2007 when he was senator Obama told the Boston Globe "The President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation". "...It is always preferable to have the informed consent of Congress prior to any military action."
Conor Friedersdorf (the author of this article) uses these quotes from president Obama himself to show that he’s well aware of the constitution’s demands. In that same interview he said: “History has shown us time and again that military action is most successful when it is authorized and supported by the Legislative branch”. This article relates to article 1 section 8 of the constitution stating that “The Congress shall have the power to declare war”. Going to war without congressional authorization is considered unconstitutional.
